Special Counsel Has Trump’s Cell Phone Data

Special counsel Jack Smith has extracted data from the cell phone Donald Trump used while in the White House and plans to present evidence of his findings to a Washington, D.C. jury to demonstrate how Trump used the phone in the weeks during which he attempted to subvert the 2020 election, Politico reports.

Russia Has Suffered Staggeringly High Losses, U.S. Report Says

Since the beginning of the war Russia has suffered from a staggeringly high number of losses, according to another newly declassified assessment shared with Congress. At the start of the war the Russian army stood at 360,000 troops. Russia has lost 315,000 of those troops, forcing them to recruit and mobilize new recruits and convicts from their prison system.

'Confused and unlawful': Trump allies accused of pushing sketchy data to sow 2024 election chaos

Donald Trump's allies are developing new methods to potentially steal the 2024 election after removing a safeguard in several Republican-led states, according to a report.

Nine GOP-led states have withdrawn from the Electronic Registration Information Center, or ERIC, after Trump allies targeted the multi-state database with conspiracy theories, and prominent election denier Cleta Mitchell has played a central role in persuading them to move away from that bipartisan security effort and instead use an open-source EagleAI software.

Their voter lists are likely to be significantly less accurate, said David Becker, a co-founder and former executive director of ERIC who left earlier this year following a right-wing pressure campaign. There will be old records on the voter lists of people who are no longer eligible in the state that will fuel false claims of potential voter fraud, and there will be inaccurate records [of those] who are eligible in the state who moved within the state that they will likely not catch.

Faulty voter lists create long lines at the polls, delay the return of mail-in ballots and create other obstacles to determining winners, Becker said, and that gives more space for losers to falsely claim the election had been stolen from them.

The more problems at the polls, the more lines, the more provisional ballots, the longer it takes to count overall ballots and get an unofficial winner, those all feed into the potential for chaos and even incitement to violence by election losers, he said.

ERIC was established in 2012 by the nonpartisan Pew Charitable Trusts to help modernize outdated voter-registration data and give trustworthy information to remove deceased or ineligible voters, but EagleAI draws from public data sources such as newspaper obituaries and property tax records to allow activists to challenge thousands of voters at a time.

Georgia's Republican-dominated Columbia County this month became the first government user of EagleAI, although the state's director of elections, Blake Evans, said earlier this year that the presentations he's seen for the tool were confused and seem to steer counties towards unlawful list-maintenance activities. https://www.rawstory.com/eagleai/

Talk of a Trump Dictatorship Charges the American Political Debate

When a historian wrote an essay the other day warning that the election of former President Donald Trump next year could lead to dictatorship, one of Mr. Trump’s allies quickly responded by calling for the historian to be sent to prison, the New York Times reports.

It almost sounds like a parody: The response to concerns about dictatorship is to prosecute the author. But Mr. Trump and his allies are not going out of their way to reassure those worried about what a new term would bring by firmly rejecting the dictatorship charge. If anything, they seem to be leaning into it.

If Mr. Trump is returned to office, people close to him have vowed to come after the news media, open criminal investigations into onetime aides who broke with the former president and purge the government of civil servants deemed disloyal. David Graham: Trump Isn’t Bluffing

What immediately leaps out here is the word vermin, with its echoes of Hitler and Mussolini. But Trump’s inflammatory language can overshadow and distract from the substance of what he’s saying—in this case, appearing to promise a purge or repression of those who disagree with him politically.

This sort of language isn’t entirely new. Trump spoke in Manichaean terms throughout his first campaign and term, encouraging chants to lock up Hillary Clinton in 2016, and in 2018 referring to undocumented immigrants as ‘animals’ who would ‘infest our country.’ Over time, the shock of Trump’s rhetoric has worn off, making it easy to miss the fact that his message has grown even darker.

Trump himself has changed, too—the old Trump seemed to be running for office partly for fun and partly in service of his signature views, such as opposition to immigration and support for protectionism. Today’s Trump is different. Aaron Blake: The history behind Jack Smith’s Trump-Supreme Court gambit

The question of Donald Trump’s criminal jeopardy could be headed to the Supreme Court sooner rather than later. That’s after special counsel Jack Smith on Monday requested that the court conduct an expedited review of Trump’s claims to “absolute” immunity from criminal prosecution for conduct in office. The court quickly signaled it will consider the petition and asked Trump’s team to respond by next week.

One way to read that request is that Smith felt this issue would ultimately wind up at the Supreme Court anyway, and he’d rather get it out of the way early in hopes of keeping the trial on track for next year. (Trump’s claim threatens to delay the election subversion trial, which is scheduled for March 4. The district judge ruled against him, but an appeals court would normally consider the case next.)

Oliver Darcy: Elon Musk demands Bob Iger ‘be fired’ after Disney pulled ads from X

Elon Musk wants Bob Iger fired.

The X owner and erratic billionaire conspiracy theorist went on a rampage Thursday against the Disney chief executive, assailing Iger for the Magic Kingdom’s decision to pull advertisements from his imperiled social media platform, and declaring that Iger should be forcibly removed from his job.

He should be fired immediately, Musk, who often uses his influential perch to bully critics and others, wrote about Iger on the platform formerly known as Twitter. Walt Disney is turning in his grave over what Bob has done to his company.

Disney, like a slew of other major companies, stopped advertising on X last month, after Musk endorsed an antisemitic conspiracy theory popular among White supremacists. Musk tacitly apologized for the post last week after the flurry of companies ceased their relationships with X, but simultaneously delivered a profanity-laced message to companies who decline to purchase ads from his social media platform.

Musk has himself repeatedly contributed to the toxicity of X. Most recently, he boosted the false – and dangerous — Pizzagate conspiracy theory. Caleb Ecarma: Tucker Carlson, Steve Bannon, Kash Patel, Stephen Miller: What a Trump Cabinet Might Look Like If He’s Reelected

To account for his inability to "drain the swamp," Donald Trump has pointed to the purportedly feckless or treacherous members of his first-term cabinet, even describing his appointments as the primary failing of his presidency. Should he win reelection, he seems determined to avoid making the same mistake, and instead fill his potential future cabinet with unequivocal loyalists and hard-liners.

According to a Thursday report from Axios, the former president has privately discussed granting top positions to Stephen Miller, Trump’s former immigration czar; J.D. Vance, a Republican senator who was once a critic of Trump but has become an America First evangelist; Steve Bannon, a popular right-wing media personality who had a short-lived advisory stint in the Trump administration; and Jeffrey Clark, a former Trump assistant attorney general who is currently under indictment for his role in the Georgia election interference scheme. Clark has pleaded not guilty to the charges.

Despite his rocky and often servile relationship with Trump, Vance was reportedly among the names floated for Trump’s vice president; also mentioned were failed gubernatorial candidate Kari Lake, Republican governors Sarah Huckabee Sanders and Kristi Noem, and Republican representatives Marjorie Taylor Greene and Byron Donald. In an odd flourish, Axios reported that Melania Trump favors former Fox News host Tucker Carlson for the role. Of course, that arrangement would mean Trump sharing the spotlight with another ex-television star. But he does not appear entirely opposed to the idea. "I like Tucker a lot," he said in an interview last month when asked about Carlson serving as his running mate. "He’s got great common sense."

If Trump regains power, he has suggested that the Justice Department would serve as the personal attack dog in his plan to destroy "every Marxist prosecutor in America" and "the radical-left thugs that live like vermin within the confines of our country."

No doubt suited for a top job is Kash Patel, a Trump loyalist who served on the National Security Council and in the Defense Department. Patel has said he would use a second Trump term to go after those in the media and government who supposedly conspired to help Joe Biden "rig" the 2020 election. "We’re going to come after you," he warned during an appearance on Bannon’s podcast. "Whether it’s criminally or civilly, we’ll figure that out." Patel made the comments two days before Axios mentioned him as one of Trump’s potential picks for national security adviser or CIA director.

Miller, the architect of Trump’s migrant family separation policy, is reportedly being considered for attorney general. Dana Milbank: Meet the Biden impeachment managers: Larry, Moe and Curly

Jim, Jason and James have become the Three Stooges of the House’s Biden investigations:, stepping on rakes and getting hit by falling flowerpots as they try to make a case for their predetermined outcome of impeaching the president. Judiciary Committee Chairman Jim Jordan is Moe, thundering and blundering in his repeated failures to prove Biden’s "weaponization" of the government. Jason Smith, the in-over-his-head chairman of Ways and Means, is Larry, brainlessly reciting whatever script is in front of him. And Oversight Committee Chairman James Comer is Curly, perpetually getting a pie in the face when the "evidence" he produces is immediately debunked.

Comer announced on social media this week, with two siren emojis. "Hunter Biden’s business entity, Owasco PC, made direct monthly payments to Joe Biden." This was evidence that the president knew & benefitted from his family’s business schemes. But it turned out the payments, for all of $1,380 each, were repayments for a 2018 Ford Raptor truck Biden helped his son Hunter buy at a time when the younger Biden was broke because of his drug addiction.

Their act is so weak that these stooges have already gone into reruns. Last week, Jordan’s "weaponization" panel held a hearing on supposed censorship at Twitter — the same topic of a hearing he had in March, with two of the same witnesses. This week, Smith’s committee had a hearing with the same two IRS "whistleblowers" who already testified about the Hunter Biden case before that panel, as well as before the Oversight Committee, earlier this year.

Comer, after seeing his allegations refuted in hearing after disastrous hearing, has said he doesn’t want to have any additional public sessions. Thomas L. Friedman: The Debate That Israel Needs Over the War

As Israel debates what to do next in Gaza, I hope Israel’s political-military leadership will reflect on the adage often attributed to Confucius: "Before you embark on a journey of revenge, dig two graves" — one for your enemy and one for yourself.

The reason I was so wary about Israel invading Gaza with the aim of totally eliminating Hamas was certainly not out of any sympathy for Hamas, which has been a curse on the Palestinian people even more than on Israel. It was out of a deep concern that Israel was acting out of blind rage, aiming at an unattainable goal — wiping Hamas from the face of the earth as one of its ministers advocated — and with no plan for the morning after.

Althea Legaspi: Elon Musk Marks Race to Bottom With Alex Jones, Ramaswamy, Andrew Tate in Live Twitter Chat

Elon Musk has reinstated infamous conspiracy theorist Alex Jones and to mark the occasion, Musk gathered a panel for an X Spaces conversation on Sunday. The discussion included Jones, Andrew Tate — who faces charges of rape, human trafficking, and organized crime; controversial Republican presidential candidate Vivek Ramaswamy; Trump’s disgraced former national security adviser Mike Flynn; and other problematic figures for an X Spaces conversation on Sunday.

The Tesla/X owner ran a poll on Friday (ending at midnight on Saturday), where users on X, formerly known as Twitter, voted to reinstate Jones, who had originally been banned in 2018. Jones had initially been suspended for a week in August of that year for incitements to violence, and the platform made the ban permanent the next month over a Periscope stream on the InfoWars account in which Jones ranted at CNN journalist Oliver Darcy for 10 minutes in a Capitol Hill hallway.

Hosted by Mario Nawful, the nearly three-hour session on Sunday found the men, unsurprisingly, crowing about some of their favorite topics. As The Wrap notes, Musk waxed on about his view that people should crank out a lot of babies (a stance he’s held for years, positing in 2021 that “civilization is going to crumble” if people don’t have more children; the mother of a set of his twins said in a biography written about him this year by Walter Isaacson: “He really wants smart people to have his kids”). Meanwhile, Jones was fixated on “globalists,” and the other people participating — including Rep. Matt Gaetz and far-right conspiracy theorist Jack Posobiec — lobbed praise on Musk and the return of Jones to the platform.

Musk’s recent decisions to reinstate extremists and conspiracy theorists while also endorsing antisemitic conspiracy theories may play well with his newly-minted, bluecheck-paying base, but it has not bolstered his standing amongst advertisers, who have abandoned X in droves. Robert Kagan The Trump dictatorship: How to stop it

Trump’s dictatorial tendencies and open disdain for the Constitution can become his greatest vulnerabilities — they might be his only vulnerabilities — if sufficiently highlighted for the American voter, and he and his advisers likely know it. Trump’s bizarre assertion that he would be a dictator only on “Day One” of his presidency to “close the border” was, believe it or not, an attempt to deflect the charge. (But what if it takes two days?) Democrats have gotten mileage in downballot races by painting their Republican opponents as lawbreaking, MAGA radicals. Trump is aware that he needs to hold on to some normal, non-cultist Republicans — that is why he has taken a more moderate position on abortion than much of the rest of the party. Trump is nothing if not a shrewd politician (the people who persist in claiming he’s an idiot should have a talk with themselves), and he knows he cannot win the general election on cult votes alone.

Can a Trump dictatorship still be prevented? Yes. It does not require a miracle, only courage. But will the people do what they need to do? Human frailty being what it is, and ambitious and selfish politicians being what they are, it is probably fanciful to imagine that the right combination of people will turn up and show a wisdom and courage they have not shown for the past eight years. Even now, we are being treated to what Abraham Lincoln called the “lullaby” arguments, the ones that urge you to go back to sleep and stop worrying. Such as: The voters will see reason. The polls are unreliable. The court system will work. Trump won’t do what he is threatening to do. Even as we get closer and closer to the possibility of a dictatorship in America, we accept the same assurances we have been accepting for the past eight years. Do we think that this time we will get a different outcome? There is a word for that.

Some readers ask fairly: What can an ordinary citizen do? The answer is, what they always do when they really care about something, when they regard it as a matter of life and death. They become activists. They get organized. They hold peaceful and legal rallies and marches. They sign petitions. They deluge their representatives, Republican or Democrat, with calls and mail, asking them to speak up and defend the Constitution. They call out their political leaders, state and local, and give them courage to stand up as well. Americans used to do these sorts of things. Have they forgotten how? At the risk of sounding Capra-esque, if every American who fears a Trump dictatorship acted on those fears, voiced them, convinced others, influenced their elected officials, then yes, that could make a difference. Another ship is passing that can still save us. Will we swim toward it this time, or will we let it pass, as we have all the others? I am deeply pessimistic, but I could not more fervently wish to be proved wrong.

Jonathan Chait: We Were Told Biden Is Secretly Running the DOJ. Why Is His Son Being Charged?

It has long been an article of faith on the right that Attorney General Merrick Garland is prosecuting Donald Trump because President Biden wants him to. Even the Trump-skeptical corners of the conservative media casually assert, without bothering to supply any evidence for the charge, that Biden is behind the DOJ investigations.

"Biden Justice Department officials and Democratic prosecutors are currently trying to put the other side’s leading contender for the White House in jail … The vapors over Trump saying he’s going to target his enemies," argues National Review editor-in-chief Rich Lowry, "is rich coming from people who have targeted their enemy by any means necessary for years now."

"Meantime, a Justice Department special counsel has filed trumped-up charges against Mr. Trump for allegedly defrauding the U.S." writes Wall Street Journal columnist Allysia Finley, "Abuse executive power. Ignore the law. Run roughshod over individual liberties. Retaliate against political opponents. Mr. Biden and his allies have done exactly what they warn Mr. Trump will do if he returns to the White House."

You’d think those conservatives might be questioning this assumption, now that Garland’s Justice Department is prosecuting Joe Biden’s son for tax evasion.
